Terms and Conditions of Service

General information and acceptance

These Terms and Conditions of Service govern the use of the website hablemos-terapia.com and the psychological therapy services offered by the collective of self-employed psychologists who manage it. In accordance with Law 34/2002 on Information Society Services (LSSI-CE), Royal Legislative Decree 1/2007 (General Consumers Act), and other applicable regulations, by using this website or booking an appointment you accept these terms in full.

If you act as an end consumer (a natural person acting outside the scope of their professional activity), you are entitled to the rights recognised under consumer protection regulations.

Description of the services

We offer online and in-person psychological therapy services in the following modalities:

  • Individual therapy for adults
  • Couples therapy
  • Neuropsychological assessments
  • Support with migratory grief
  • Child and adolescent therapy
  • Lacanian psychoanalysis
  • Online therapy by video call

IMPORTANT: The services offered DO NOT replace in-person emergency healthcare. If you are in a crisis situation, at risk of suicide or in a medical emergency, contact 112 (emergencies) or 024 (Suicidal Behaviour Helpline) immediately.

Psychological therapy is a personal and unique process. We do not guarantee specific results or fixed improvement timescales, as they depend on multiple individual factors.

All the professionals are subject to the Code of Ethics of the General Council of Psychology of Spain and to Law 44/2003 on the regulation of health professions.

Booking, management and appointment conditions

To book an appointment:

  • Complete the booking form with your real and truthful contact details.
  • Select the psychologist, modality and preferred time.
  • Wait for our confirmation by email or WhatsApp (within 24 working hours).
  • You will receive the session details (video call link or in-person address).

An appointment is only considered confirmed when you receive our written confirmation. Until then, there is no binding contract.

Cancellation and rescheduling policy

A minimum notice of 24 NATURAL HOURS is required to cancel or reschedule an appointment without charge.

Cancellations with less than 24 hours' notice may be subject to 100% of the session cost, as the reserved time cannot be offered to another patient.

Failure to attend without prior notice (no-show) will result in the full charge of the booked session.

Repeated cancellations without notice may result in the denial of future bookings.

Exceptionally, no late cancellation charge will apply in duly justified cases of force majeure (serious illness, accident, death of a direct family member).

Payment conditions

Payment is made at the end of each session by:

  • Bank transfer (IBAN will be provided after the session)
  • Bizum (phone number will be provided after the session)
  • Cash (in-person sessions only)
  • Credit/debit card (if available)

Payment must be made on the spot, unless previously agreed in writing. Non-payment may lead to the suspension of future appointments until the debt is settled.

An invoice will be issued for each session in accordance with current tax regulations. For this, we will need your full tax details.

Current fees are available at the time of booking and may be updated periodically. The applicable price will be the one in force at the time of booking.

Schedules and availability

Sessions are booked on mainland Spain time (CET/CEST). It is the patient's responsibility to be aware of the time difference if located in another time zone.

The session will start at the agreed time regardless of the patient's arrival time. Delays of more than 15 minutes may result in the cancellation of the session.

The standard duration of each session is 50 minutes, unless previously agreed otherwise for different formats.

User/patient obligations

By using this website and our services, you undertake to:

  • Provide truthful, accurate and complete information in the forms and during sessions.
  • Use the website in accordance with the law, these terms and established morality.
  • Respect the agreed session times and notify any incident in advance.
  • Pay for the sessions as agreed and within the established deadlines.
  • Not use the website for unlawful, harmful, offensive or prejudicial purposes towards third parties.
  • Not attempt to access restricted areas of the system or breach its security.
  • Not reproduce, distribute or publicly communicate the website contents without authorisation.
  • Not use automated tools (bots, scrapers) to access the website.
  • Report any misuse or security breach you become aware of.
  • Respect the therapeutic framework and the professional guidance of the psychologist.
  • Not record sessions without the psychologist's explicit written consent.
  • Not contact the psychologist outside professional hours except in an agreed emergency.

Right of withdrawal (consumers only)

In accordance with Article 103 of Royal Legislative Decree 1/2007 (General Consumers Act), psychological therapy services are EXCLUDED from the 14-day right of withdrawal when:

  • Performance of the service has begun with the consumer's express consent.
  • The service is provided within a fixed term or on a specific date (scheduled appointment).

However, you may cancel your appointment in accordance with the cancellation policy described above. If the session has already been provided, no refund applies.

In the case of advance payment for sessions not held, the corresponding amount will be refunded within a maximum of 14 natural days.

Intellectual and industrial property

All the contents of this website (texts, images, photographs, graphics, logos, icons, design, source code, software, trade names, trademarks) are the property of the Hablemos Terapia collective or of their respective authors and are protected by:

  • Royal Legislative Decree 1/1996 (Intellectual Property Act)
  • Law 3/1991 (Unfair Competition Act)
  • Law 17/2001 (Trademarks Act)

Their reproduction, distribution, public communication, transformation or any other unauthorised use without prior written authorisation is prohibited. Unauthorised use may constitute a criminal offence under the Criminal Code (arts. 270 et seq.).

A limited, non-exclusive, non-transferable and revocable licence is granted to access and use the website for personal, non-commercial purposes.

Limitation and exclusion of liability

The Hablemos Terapia collective is NOT liable for:

  • Temporary technical errors on the website, service outages or interruptions in service provision.
  • Content of third-party linked websites (social networks, official bodies, etc.).
  • Decisions made based on the information on this website without prior professional consultation.
  • Specific therapeutic outcomes (each process is unique and results are not guaranteed).
  • Misuse of the website by users or third parties.
  • Damage caused by viruses, malware or harmful elements beyond our control.
  • User-generated content on social networks or external platforms.

Each psychologist's professional liability is covered by her respective professional civil liability insurance. Each professional is individually responsible for the services she provides.

In no case shall total liability exceed the amount paid for the service that gave rise to the claim.

Confidentiality and professional secrecy

All information shared in therapy sessions is protected by PROFESSIONAL SECRECY, in accordance with:

  • Code of Ethics of the General Council of Psychology of Spain (art. 41 et seq.)
  • Law 44/2003 on the regulation of health professions (art. 61)
  • Criminal Code (art. 199 et seq.)

Information may only be disclosed with your explicit written consent, or by legal obligation (court order, serious risk to your integrity or that of third parties, duty to report).

Clinical notes and the therapeutic history are kept under strict confidentiality with reinforced security measures.

Minors

Therapy services for minors under 18 require the EXPRESS CONSENT of the parents or legal guardians.

  • Both parents/guardians must give written informed consent.
  • They must authorise the processing of the minor's data in accordance with the GDPR.
  • At least one of them must be present at the first session.
  • For minors under 14, consent must be given by both parents.

Emancipated minors or those aged 16 and over who live independently may consent for themselves, in accordance with Law 41/2002 on patient autonomy.

Electronic communications

In accordance with Law 34/2002 (LSSI-CE), you accept the receipt of electronic communications related to:

  • Appointment confirmations and reminders.
  • Invoices and commercial documents.
  • Communications related to the provision of the service.

Commercial communications (newsletter, promotions) will only be sent with your explicit consent, which you may withdraw at any time.

Communications will be sent to the email address or phone number provided. It is your responsibility to keep your contact details up to date.

Applicable law and jurisdiction

These terms are governed by Spanish law, in particular:

  • Law 34/2002 on Information Society Services (LSSI-CE)
  • Royal Legislative Decree 1/2007 (General Act for the Protection of Consumers)
  • Law 44/2003 on the regulation of health professions
  • Code of Ethics of the General Council of Psychology of Spain
  • Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD)

Any dispute that may arise from the interpretation or performance of these terms shall be submitted to the Courts and Tribunals of the city of the USER'S DOMICILE, in accordance with Article 52 of the Civil Procedure Act and Article 52 of Royal Legislative Decree 1/2007 (consumer forum).

For consumers: you may submit to the Consumer Arbitration System to resolve disputes (www.consumo.gob.es).

Online dispute resolution platform (ODR)

In accordance with Regulation (EU) 524/2013, we inform you of the existence of the European Union's Online Dispute Resolution Platform.

This platform allows the out-of-court resolution of disputes related to online purchases. Its use is voluntary and not mandatory.

Modification of the terms

We reserve the right to modify these terms at any time without prior notice.

The changes will come into force immediately after their publication on this page. We recommend that you review this page periodically.

Continued use of the website after the publication of modifications implies acceptance of the new terms.

Partial nullity

If any clause of these terms is declared null or invalid, the remaining clauses shall remain in force and produce full effects.

The null clause shall be interpreted in the sense that most closely approximates the original intention of the parties.
